Amos Miller Case Drags On


Amos Miller operating Miller’s Organic Farm in Bird-in-Hand, PA. is the subject of continuing litigation following raw milk recalls due to listeriosis in 2015.

Miller is by all accounts a scofflaw. He has ignored USDA and FDA regulations and has failed to present a viable defense in Federal court.  Miller has now raised financial support using GoFundMe to retain legal representation.


The U.S. Attorney’s Office for Eastern Pennsylvania has stated in court that is the intent of the USDA and FDA to require Miller and his farm to comply with federal food safety laws.

The U.S. Attorney prosecuting the case William M. McSwain observed that “flagrant failure to meet regulations will not be tolerated”.


To allow Miller to continue evading his legal responsibilities would create an unacceptable precedent. It is unclear how Miller intends to respond to a detailed and comprehensive civil complaint alleging processing and sale of meat and poultry product without USDA inspection.  Given that his public funding campaign has only raised a quarter of the required amount of $23,000 for his defense, his legal representatives will either terminate their involvement, as occurred two years ago, or will serve pro bono.


Miller must accept that there is no “God given right” to distribute unwholesome meat and milk or to potentially infect consumers with pathogens including Listeria, Salmonella, STEC and Campylobacter.
